These Terms of Service apply to purchases made through Lumova Retail Ltd and the use of www.lumova.co.uk.

By placing an order with us, you agree to these Terms. Nothing in these Terms affects your statutory rights as a consumer.

2. Orders

When you place an order, you are offering to purchase the products in your basket subject to these Terms.

You will receive an order confirmation after placing your order. We reserve the right to decline or cancel an order where reasonably necessary, including where:

• A product is unavailable;

• There is an obvious pricing or listing error;

• Payment cannot be authorised;

• We reasonably suspect fraudulent activity; or

• We are unable to deliver to the address provided.

If payment has already been taken for an order we cannot fulfil, you will receive a full refund.

3. Products

We take reasonable care to ensure product descriptions, photographs, ingredients and other information displayed on our website are accurate.

Product packaging, formulation or appearance may occasionally change where a manufacturer updates a product. Customers should always read the product packaging, ingredients, warnings and instructions supplied with the product before use.

Colours and appearance may vary slightly from images displayed on different devices.

4. Prices and Payment

All prices are shown in GBP (£) and include applicable taxes where required.

The price payable is the price displayed at checkout when your order is placed, together with any applicable delivery charges.

Payment must be successfully authorised before an order is processed.

If an obvious pricing error occurs, we are not required to supply a product at an incorrect price. We will contact you and give you the option to purchase the item at the correct price or cancel the order for a full refund.

5. Delivery

Available delivery methods, charges and estimated delivery times are displayed on our website and/or during checkout.

Delivery times are estimates unless expressly stated otherwise. We are not responsible for delays outside our reasonable control, but this does not affect your statutory rights.

Please ensure the delivery address provided at checkout is complete and accurate.

If a parcel is returned to us because an incorrect or incomplete address was supplied, additional postage charges may apply before the order is resent.

6. Returns, Cancellations and Refunds

Returns, cancellations and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

For most eligible online purchases, consumers have a statutory right to cancel within 14 days of receiving their goods.

Certain sealed cosmetic, beauty, skincare and similar products may not be eligible for change-of-mind returns once unsealed where they are unsuitable for return for health or hygiene reasons.

This does not affect your rights where an item is faulty, damaged, incorrectly supplied or not as described.

7. Damaged, Faulty or Incorrect Products

Please inspect your order as soon as reasonably possible after delivery.

If you believe an item has arrived damaged, faulty or incorrect, contact hello@lumova.co.uk as soon as possible, preferably within 48 hours of delivery, with your order number and photographs where appropriate.

Reporting an issue outside this period does not affect your statutory rights.

8. Product Use

Products must be used in accordance with the instructions, warnings and guidance supplied by the manufacturer.

You are responsible for checking product ingredients and suitability before use, particularly if you have known allergies, sensitivities or medical concerns.

Discontinue use if you experience an adverse reaction and seek appropriate medical advice where necessary.

Lumova Retail Ltd is a retailer and does not manufacture the products sold unless expressly stated otherwise.

Nothing on our website should be considered medical advice.

9. Availability

All products are subject to availability.

Adding a product to your basket does not reserve it. If an item becomes unavailable after an order has been placed, we will refund the affected item or order.

10. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional terms, including minimum spends, expiry dates or restrictions on certain products.

Unless stated otherwise, discount codes cannot be combined.

We may withdraw or amend a promotion where reasonably necessary, but this will not affect orders already accepted.

11. Website Use

You must not misuse our website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation or use it for unlawful purposes.

We may restrict access to the website where reasonably necessary for security, maintenance or legal reasons.

12. Intellectual Property

The content of the Lumova website, including Lumova branding, graphics, photographs, text and website design owned by us, is protected by applicable intellectual property laws.

You may not reproduce or commercially use our owned content without prior written permission.

Third-party product names, trademarks and imagery remain the property of their respective owners.

13. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

To the extent permitted by law, Lumova Retail Ltd will not be responsible for losses that were not reasonably foreseeable when the contract was entered into.

We are not responsible for loss resulting from misuse of a product, failure to follow manufacturer instructions or use contrary to stated warnings, except where liability cannot legally be excluded.

14. Events Outside Our Control

We will not be responsible for failure or delay caused by events outside our reasonable control, such as postal disruption, severe weather, transport disruption or other circumstances which we could not reasonably prevent.

We will take reasonable steps to minimise the effect of any such delay.

15. Changes to These Terms

We may update these Terms from time to time.

The Terms that apply to an order will be those in force when the order is placed. Any changes will not retrospectively alter an existing order.

16. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory rights available to you under the laws applicable where you live.

Nothing in these Terms limits your statutory consumer rights.
